Judge Keeps Nushawn Williams in Jail, For Now

BUFFALO, NY - A State Supreme Court Judge ruled Monday that the sex offender who infected over a dozen women in the Jamestown area with the AIDS virus will remain behind bars as a dangerous sex offender even though his prison term is over from his original sentence.

Nushawn Williams argued it was unfair to keep him in jail under New York's recently passed Civil Confinement statute. His attorney argued that the new law was passed after Williams' rape sentence was completed. He was, however, still serving time for a reckless endangerment sentence.

The state's Attorney General's office contended that as long as Williams was still in prison, the state could move to place him in civil confinement for life.  State Supreme Court John Michalski denied a motion to dismiss the case.

Monday's ruling was in response to a motion by Williams' attorney. The case of whether or not he can be kept in jail will still go to trial.
